#1204 fences and vandalism

2011-07-26 12:02

People bang on about the cost of the fencing but the truth is that it's our taxes that are paying for these schemes up and down the country. The 400 million that NE dishes out every year is paid for by you and I. I do not think people realise that in the context of the thousands of people jumping on this bandwagon. It was not vandalism, I and anbody is in fact compelled by law to remove illegal imediments. So far, we have yet to be issued a caution, never mind treated as vandals. The court hearing was for the recovery of costs, subject to the above because they could not prove title. The fencing coming down and an end to this scheme would save the tax payer a small foutune, locally and nationally.

#1218 Ian Liddel Grainger talking in the house of commons

Subject: Hartlebury Common

Dear Peter

Hartlebury common is a much loved and much used amenity by people of all sorts. Up until 2006 it enjoyed protected status under Hartlebury Enclosure act of 1815. This meant that no one group or persons could influence for personal gain, profit or any other means of influence that were counter to the opinion of the wider population and common people and any other person.
How times have changed.

Worcester Commons Association have gathered 1300 supporters in just 4 weeks and the number is rising daily opposing the so called conservation of our historic open spaces.

Natural England is instrumental in the destruction of our natural places, your fellow MP, Ian Liddell Grainger has plenty to say on this subject. http://www.publications.parliament.uk/pa/cm201011/cmhansrd/cm101026/halltext/101026h0002.htm

Can you explain how the following, below was allowed to happen?

The County Council (Worcestershire) applied to the Secretary of State for Environment, Food and Rural Affairs for consent under section 38 of the Commons Act 2006 to carry out restricted works on Hartlebury Common (52) and then gave legal notice that any objections should be made to the Planning Inspectorate by 9 January 2009. The Open Space Society is not happy. By statute they are notified of all applications for works on common land submitted to the Secretary of State for Environment, and they have certainly objected to this one. Their local representative, Edgar Powell, doesn't think the council can lawfully erect fencing there in any case (54):
“We cannot understand why Worcestershire County Council proposes to fence the common when it must know that, under the Hartlebury Enclosure Act of 1815 (the associated award being sealed in 1821), it is illegal ‘to divide or enclose’ the common, and that it needs an Act of Parliament to revoke this clause”

Below is the link to our web page which clarifies our standpoint.

Best wishes, I look forward to your reply

Grazing 'stopping moor walkers' (Score: 1)
by Andy B (andy@megalithic.co.uk) on Monday, 22 March 2010

A scheme allowing cattle to graze on moors is spoiling land and discouraging walkers, moor users in Cornwall say.

Under the Natural England Environmental Stewardship Scheme, cattle are allowed to graze on land, often near footpaths, in a bid to encourage wildlife.

The Save Penwith Moors group said it had resulted in more fences being erected. Occasional confrontations with grazing animals have also occurred.

Natural England said the scheme helped endangered species flourish

Conservationists said grazing helped protect the natural habitat because it controlled undergrowth, which encouraged insects, which, in turn, helped feed other birds and animals.

However, walkers said that allowing animals more grazing land resulted in the building of obstacles on moors that had been open for generations.

Moor users said there had been confrontations with animals

Ian Cooke, of the Save Penwith Moors group, said: "In the last year, the Natural England project has erected cattle grids and gates at 10 access points. It's just not acceptable.

"There are far fewer people walking these areas than there were two years ago."

#1221 Hartlebury Common has very important prehistoric archaeology

BBC Radio 4 Open Country about Conservation Grazing in Cornwall (Score: 1)
by Andy B (andy@megalithic.co.uk) on Monday, 20 September 2010

Helen Mark is in Cornwall to find out why the reintroduction of cattle to graze the Penwith Moors of Cornwall and improve the area's bio-diversity has upset some of the local community. She meets up with archaeologist Craig Weatherhill at the Tregeseal Stone Circle to hear about the damage he says is being caused to these ancient monuments by the horns of the non-native Longhorn breed of cattle being grazed on the moors. Craig also tells Helen about the difficulties faced by horses and their riders from the newly erected gates and fences which they have to pass through.

At Carn Galva, one of Cornwall's most unique and pre-historic landscapes, Helen meets up with Peter Bowden from Natural England and Jon Brookes of the National Trust who explain the reasons for the conservation grazing scheme and how important it is to this ancient landscape. This heathland is of national and international importance and the grazing scheme is intended to open up footpaths the natural way, avoiding the need for heavy machinery and herbicides, and fences and cattle grids have been put there to keep cattle in and not people out. However, when Helen joins Ian Cooke and Steve Yandall of the Save Penwith Moors campaign, she hears about their concerns for the environment and how emotional they felt to have barbed wire fences appearing out on the moors.

But when she arrives at Trengwainton Farm near Penzance, farmer Stephen Bone takes Helen to a part of his land that his father fenced and grazed 40 years ago and which soon became waist high in bracken when the cattle were taken in. Stephen is actually now busy re-fencing his land ready to graze animals there as part of the Conservation Grazing Scheme. He tells Helen that he has offered an olive branch to those opposed to the scheme by suggesting that he take his livestock in during the busy summer months and school holidays.

Finally, Helen meets up with Stephen Warman who has been brought in to try and resolve the situation and to narrow the gap between the two opposing sides. Where do they all go from here in order to manage the moors in the best way for all those who care about this landscape?.

Cattle potentially endangering Stone Circle (Score: 1)
by Andy B (andy@megalithic.co.uk) on Monday, 22 March 2010

The longhorn cattle on Carnyorth moor have been photographed on several occasions grazing inside Tregeseal prehistoric stone circle and using the stones as rubbing posts. Not only is there a very real possibility that some of the stones will be dislodged but that their presence will also intimidate visitors.

The Historic Environment Service of Cornwall Council have been informed by the following email (sent 17/6/2009 18.49; read by Attmere Lauren of HES 18/6/2009 7.41).
“As a partner of the HEATH Project you are doubtless aware that a group of longhorn cattle are now grazing Carnyorth Moor, They have been seen and photographed on several different days within the stone circle that seems to act as a magnet, and also using the stones as rubbing posts. Can you assure me that someone from the HES will be monitoring this site on a regular basis for any damage - as you know some of the stones are hardly embedded in the soil. If there is any damage to the circle then our group will take appropriate action against those responsible.”
