PETITION BY CONCERNED RESIDENTS OF LEISURE BAY
REGARDING: SADHI BEACH HOUSE – 1165 MARLIN DRIVE

We, the undersigned residents of Leisure Bay, formally lodge this petition against the continued operation and conduct of the property known as Sadhi Beach House, 1165 Marlin Drive, due to persistent, severe, and ongoing violations of municipal by-laws and residential zoning expectations.

GROUNDS FOR PETITION

The property is being operated in a manner that is incompatible with a residential environment and constitutes an ongoing nuisance and disruption to the community.

1. Excessive and Continuous Noise Disturbances

  • Loud amplified music at extreme volumes for extended durations

  • Noise levels sufficient to penetrate closed homes, preventing rest and sleep

  • Repeated disturbances occurring over full weekends and late hours

2. Hosting of Large-Scale Events

  • Use of the property for gatherings resembling nightclubs, parties, or commercial functions

  • Installation of professional sound systems, lighting rigs, and event-style infrastructure

  • Attendance numbers significantly exceeding typical residential use

3. Severe Overcrowding / Over-Accommodation

  • Accommodation of excessively large groups (reported upwards of 30–50 individuals)

  • Use of the premises beyond reasonable or permitted occupancy levels

  • Increased pressure on parking, infrastructure, and surrounding residential space

4. Commercial Use in a Residential Zone

  • Operation consistent with an event venue or entertainment facility

  • Frequency and scale of activities indicative of ongoing commercial use

  • Activities inconsistent with standard residential or compliant guest accommodation

5. Failure to Control Guest Conduct

  • Lack of enforcement of basic behavioural standards by the property owner

  • Repeated allowance of disruptive, excessive, and unlawful guest behaviour

  • Ongoing disturbances despite prior warnings and complaints

6. Public Nuisance and Loss of Residential Enjoyment

  • Interference with residents’ right to peace, quiet, and safety

  • Disruption to families, including children unable to sleep due to noise levels

  • Erosion of the residential character and livability of the area

7. Ongoing Law Enforcement Involvement

  • Repeated complaints lodged with Ray Nkonyeni Municipal Law Enforcement

  • Acknowledgement by enforcement officials of the excessive and recurring nature of complaints

  • Lack of lasting resolution despite intervention attempts

8. Unverified Business Licensing and Regulatory Compliance

  • It is understood that short-term rental and guest accommodation operations require appropriate registration and/or business licensing within Ray Nkonyeni Municipality

  • Residents have made attempts to confirm whether the property is duly registered and compliant

  • At present, the existence and validity of such licensing or registration cannot be confirmed

  • This raises serious concerns regarding the legality of the property's operation

REQUEST FOR ACTION

We respectfully request that the Ray Nkonyeni Municipality:

  • Conduct a full investigation into the legality of the property’s current use

  • Verify zoning compliance, occupancy limits, and operational scope

  • Confirm business licensing and regulatory compliance

  • Enforce all applicable by-laws and regulations

  • Implement immediate measures to prevent further disturbances

  • Impose penalties or restrictions where violations are identified

  • Suspend or shut down operations should non-compliance be confirmed

DECLARATION

We confirm that the above concerns reflect ongoing and repeated experiences within our community and are submitted in good faith for urgent municipal intervention.
