#247382015-10-08 14:17هر انسانی حق دارد که در مساوات کامل از امکان داشتن دادرسی منصفانه و علنی توسط یک محکمه مستقل و بی طرف جهت پیگیری حقوق و مطالبات خود یا برای دفاع از هر اتهام جزایی که به او وارد شده است بهره‌مند گردد. {۷۶} حق برخورداری از محاکمه‌ای منصفانه در اسناد و معاهدات حقوق بشر بین‌المللی و منطقه‌ای متعددی بیان شده است. که یکی از گسترده ترین مصادیق حقوق بشر بوده و تمام اسناد بین‌المللی حقوق بشر در بیش از یک ماده آن را مورد توجه قرار داده‌اند. {۷۷} حق برخورداری از محاکمه‌ای منصفانه یکی از دعوی برانگیزترین مسائل حقوق بشر است و موارد قانونی محکمی در تفسیر این حق ایجاد شده است. {۷۸} علی رغم تفاوت‌ها در جمله بندی‌ها و نگارش‌های متنوع "حق داشتن دادگاه منصفانه "، اسناد و معاهدات حقوق بشر بین‌المللی حق برخورداری از دادگاه منصفانه را به صورت گسترده‌ای با عبارات مشابه تعریف کرده است. {۷۹} هدف این حق حصول اطمینان از اجرای مناسب عدالت است. حداقل‌های قابل قبول در حق برخورداری از دادگاه منصفانه متشکل از موارد آمده در ذیل در محاکمه‌های کیفری و مدنی است: {۸۰} • حق برخورداری از دادگاهی صالح، مستقل و بی‌طرف • حق برخورداری از جلسه محاکمه عمومی • حق تشکیل محاکمه در بازه زمانی معقول • حق داشتن وکیل مدافع • حق تفسیر {۸۰} |
